Terms and Conditions of Use of the Website (https://www.motionspace.eu/)

 

  1. Motionspace s.r.o., registered office: Námestie svätého Egídia 68/6 058 01 Poprad, VAT ID: 50 539 833 as the controller (hereinafter referred to as the “Controller”) guarantees the security and protection of the entrusted personal data in full compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “GDPR”) and with Act No. 18/2018 Coll. on the protection of personal data and on amending and supplementing certain acts, as amended from time to time.

 

  1. COOKIES.
    When using the motionspace.eu website, cookies (small files that provide tracking of the user’s activity on the website) may be stored on the electronic device with which the user accesses the website. The conditions for storing and processing cookies are as follows:

    • The user always has the possibility to agree or refuse the storage of cookies by setting his/her web browser to allow or refuse the storage of cookies.
    • In case of consent (permission) cookies can be stored on the user’s electronic device:
      1. temporary cookies, which are automatically deleted when the user’s browser is switched off,
      2. long-term cookies, which remain on the user’s internet browser even after the user has switched off the device used to access the motionspace.eu website (these cookies can be deleted by the user at any time and are also deleted automatically after a few weeks or months).
    • By consenting, the user also authorises the operator to use the cookies for its own record-keeping or statistical purposes, and for the purposes of targeted advertising by partners with whom it has entered into special agreements for the display of advertising on the website. The user’s consent lasts for as long as the settings of the user’s internet browser are maintained. By changing the settings of the user’s browser or by prohibiting the use of cookies, the user’s consent ceases to be valid.
    • The Provider is not responsible for the storage of cookies on third-party websites or the use of cookies stored on the User’s terminal device by third parties.
    • In case of refusal of consent (refusal of cookies in the web browser), the operator cannot guarantee the full functionality of the motionspace.eu website, in particular does not guarantee the possibility of logging into the members’ section.

 

  1. WEBSTRING.
    The motionspace.eu website uses an encrypted SSL connection for any user connection and transmission of any data, which prevents third parties from accessing the transmitted data while it is being transmitted on the Internet and the alteration of such data by third parties. The Controller’s databases containing personal data are protected by encryption and non-public access data in accordance with state-of-the-art technical standards.

 

  1. CONTACT DATA.
    The user may contact the controller during his/her visit and further use of the motionspace.eu website and provide him/her with his/her personal data for the purpose of contacting him/her back.

    • The provision of personal data is voluntary. The legal basis for processing the data provided by the user in this case is the legitimate interest of the controller to contact the user and provide any answers or advice.
    • The personal data that the user may provide to the controller are:
      1. first and last name [essential]
      2. email address [necessary]
      3. telephone number [necessary]
      4. company (workplace/employer) of the user.
    • PURPOSE. The purpose of processing the user’s personal data is to contact the user back.
    • PURPOSE OF PROCESSING. The personal data will only be processed for the necessary period of time during the communication with the user.
    • RIGHTS. By voluntarily providing personal data, the user declares that the data provided is correct, true and up-to-date.

 

  1. NEWSLETTER.
    The user – the data subject may provide the controller with his/her personal data when visiting and further using the motionspace.eu website. The provision of personal data of the user may occur when the user voluntarily registers for the newsletter using an e-mail address from which the user’s identity can be determined, or when the user voluntarily fills in a contact form associated with the selected content of the website.The provision of personal data is voluntary. A necessary condition for the processing of the user’s personal data by the operator for the purpose of sending the newsletter is the granting of the user’s consent to the processing of personal data to the extent necessary and to the sending of marketing messages, this consent being the sole legal basis for the processing of the data provided by the user (email address).

    • In order to ensure the controller’s authorisation to process the personal data provided, the user must consent to the storage and further processing of the personal data obtained, to the extent necessary to achieve the purpose set out in this article.
    • WITHDRAWAL OF CONSENT. The user’s consent pursuant to the previous paragraph shall take effect at the moment of the voluntary provision of consent by ticking the relevant box in the online form and shall last for a period of two years or until the user withdraws consent. The controller has the right to process the data provided for the duration of the consent.
    • PURPOSE. The purpose of the processing of the user’s personal data is to enable the user to subscribe to the newsletter (newsletter) requested by him/her by sending such newsletter of the controller to the contact addresses provided by the user, in particular in electronic form.
    • RIGHTS. By voluntarily providing personal data, the user declares that the data provided is correct, true and up-to-date, otherwise he/she is liable for any damage that the provision of incorrect, false or outdated data may cause to the operator. The user is obliged to notify the operator of any change to the personal data provided.
    • DATA TRANSMISSION AND AUTOMATED DECISION-MAKING. The user’s personal data will not be disclosed or provided to third parties, will not be transferred to countries outside the European Union, nor will the controller make decisions relevant to the user on the basis of the data in an automated manner.

 

  1. Learning about the rights of the affected person.
    The user’s rights in relation to the protection of personal data are governed in particular by the provisions of Articles 12 to 22 of the GDPR, as amended from time to time.
    In particular, as a user, you have the right, on the basis of a written or e-mail request addressed to the controller (e-mail: hello@motionspace.eu), to request:

      1. confirm whether or not personal data about you are being processed, access to and information about your personal data, as well as the rectification of such data,
      2. restrict the processing of your personal data, in particular if it is incorrect,
      3. deletion of your personal data, in particular if the purpose for which they were processed has ceased to exist or if you have withdrawn your consent to processing,
      4. transfer of your personal data to another controller in a structured and machine-readable form.

    You also have the right by written notice or email (to hello@motionspace.eu):

    1. withdraw your consent to the processing of your personal data at any time, with effect from the date of receipt of the notice if the processing of your personal data is carried out on the basis of consent, provided that the lawfulness of the processing prior to the receipt of the notice of withdrawal of consent shall be preserved,
    2. if the processing of personal data is not carried out on the basis of your consent, to object to the processing on grounds relating to your personal situation or if you suspect that the data are being processed unlawfully.

    You also have the right to lodge a complaint with the Office for Personal Data Protection, as the supervisory authority for the Slovak Republic, or a complaint to investigate the processing of your personal data.

    The rights of the user and/or the member may be restricted if such restriction results from a specific regulation, their exercise would violate the protection of the user or would violate the rights and freedoms of other data subjects.
